Distributing Attorney Fees in Multidistrict Litigation

Abstract As consolidated multidistrict litigation has come to dominate the federal civil docket, problem of how divide attorney fees among participating firms become source frequent and protracted litigation. For example, in National Football League (NFL) Concussion Litigation, judge awarded plaintiff attorneys over $100 million fees, but division those twenty-six involved sparked two additional years We explore solutions this fee problem, drawing insights from economics, game theory, industrial organization literatures. Ultimately, we propose a novel method based on peer reports. Participating assess relative contribution other litigation, then optimization or Bayesian techniques arrive at consensus compromise allocation. Our methods are intuitively easy understand, enable broad participation, resistant collusion strategic behavior, making them likely be accepted by involved. thus provide courts with an important mediation tool decision rule for these disputes.
